Why should I choose a PhD mediator over a retired judge or an attorney-mediator?
Attorneys and retired judges are exceptional at evaluating the legal merits of a case—they focus on what a court might do. However, cases that hit a ‘hard impasse’ rarely do so because of a lack of legal analysis; they stall because of the submerged psychological drivers, emotional barriers, and communication breakdowns that traditional legal posturing cannot reach.
As a PhD-led mediator, my focus is not on judging the past, but on engineering the future. I specialize in the behavioral mechanics of settlement. By shifting the focus from ‘who is right’ to ‘what is the solution,’ I provide the specialized communication tools necessary to de-escalate high-tension environments and uncover the hidden interests that lead to a signed agreement. You provide the legal expertise; I provide the path to the “Yes.”
How does your research background translate to the mediation table?
My research, which has been cited over 200 times, focused on studying people, so I am able to analyze conflict patterns in real-time. Instead of guessing why a party is upset, I use communcation theory and strategies to de-escalate and pivot them toward a solution.
How do you handle the legal ‘Black Letter Law’ aspects of a case?
In most of the mediations I conduct, the clients are represented by competent attorneys, who are experts on the law. Since I do not make decisions about the resolution, I can safely rely on each attorney to provide the legal advice to their respective clients. My role in these situations is to support the attorney’s expertise with their client. This strategy allows me to remain completely neutral.
